Synopsis - Notice of Intent to Sole Source



THIS NOTICE IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY



This synopsis is hereby issued in accordance with FAR Part 5.203 in response to the mandatory requirement for a 15-day notification. The purpose of this synopsis is to announce the intent of ­the Naval Air Warfare Center Aircraft Division (NAWC-AD) to negotiate a Firm Fixed Price (FFP) contract on a sole-source basis to Northrop Grumman Corporation (NGC), for a term necessary to perform production and delivery of replacement Northrop Grumman Corporation (NGC) F-5N/F Wheel Braking Skid Control System Components, Wheel Braking Skid System Control Box part number (P/N) 14-40904-11 / 6002064-1 and Wheel Braking Skid System Control Valve (P/N) 14-40904-3 / 6002067 to ensure maintainability and supportability throughout the remaining lifecycle of the F-5F/N aircraft in the U.S. Navy and U.S. Marine Corps inventory. The types and quantities of components required are forecasted based on NAVAIR calculated Failure Mode, Effects, and Critically Analysis (FMECA) data and historical usage data of the F-5N/F Wheel Braking Skid Control System resulting in identification of two (2) primary system degraders impacting mission capability. The proposed contract action is for procurement of F-5F/N Wheel Braking Skid Control System Components of which the NAWC-AD intends to solicit and negotiate with only one source under the statutory authority of 10 U.S.C. 3204(a)(1) (formally known as 10 U.S.C 2304(c)(1)), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements.



Currently, NGC is the only known source that possesses the requisite knowledge, technical capability, and technical data for the manufacture and delivery of the required items and services without substantial duplication of costs that is not expected to be recovered through competition. The supplies and/or services described above are available only through NGC, to manufacture the above referenced part numbers for the Navy’s F-5F/N aircraft. While the Navy has the Northrop Corporation Product Function Specification for the F-5 Wheel Braking Skid Control System the information contained within does not provide the required detail or build-to-print drawings / schematics of the above referenced part numbers that would provide for competitive solicitation of the Government’s requirement. The Government does not own the data needed to contract for these parts from additional manufacture sources and it is uneconomical to purchase the rights to the data, or reverse engineer the parts. NGC being the sole designer, developer, and manufacturer of the F-5F/N Wheel Braking Skid Control System Components, solely owns the technical data package for the production of the currently installed F-5F/N Wheel Braking Skid Control System Components. Additionally, NGC is the only approved source within the Department of the Navy as the Designer and Original Equipment Manufacturer (OEM) of the Navy’s F-5F/N Wheel Braking Skid Control System Components as designated by the NAVAIR F-5 Fleet Support Team (FST) as the Navy F-5’s design control activity for aviation critical safety items and is responsible for identifying, qualifying, and approving manufacturing sources and suppliers, in accordance with DFARS 209.270 Aviation and Ship Critical Safety Items (CSIs).

A determination by the Government not to compete the proposed contract action based upon responses to this notice is solely within discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Responses received by 12/12/2022, 3:00 PM Eastern Time may be considered.
