Description

This notice is for acquisition of commercial supplies and/or services for which the Government intends to negotiate with only one source. This acquisition will be processed under Federal Acquisition Regulation (FAR) Acquisition for Commercial Items and will be made pursuant to the authority of 41 U.S.C. 1901 Use of Non- Competitive Procedures and 13.106-1(b)(1) Soliciting from a Single Source.



It is the intent of the National Institutes of Health (NIH) National Library of Medicine (NLM) to make an award to Xemistry GMBH, AUFDEN STIEDEN 8, Lahntal, 35904, for software support and maintenance renewal of CACTVS Cheminformatics Toolkit. The software is proprietary to Xemistry GMBH and Xemistry GMBH is the only known source capable of providing the related support services.



This acquisition will be processed under FAR Part 12- Acquisition for Commercial items in combination with simplified acquisition procedures contained in FAR Part 13 Simplified acquisition procedures, Subpart 13.5, “Simplified procedures for certain commercial items: in accordance with 41 U.S.C. 1901. This notice incorporates provision and clauses in effect in the FAC 2023-02 effective 3/16/2023, including all FAR Circulars issued as of the date May 16, 2023. NLM anticipates that an award will be made on or about July 10, 2023



The North American Industry Classification System Code (NAICS) applicable to this requirement is 541519 (Exception) and the business size standard is 150 employees.



This will be a firm fixed price type order.




  • Python Scripting Interface-stand-alone interpreter, or loadable module for any Python 3- enable software.

  • TcL Scripting Inteface-stand-alone truly multithreading interpreter, or loadable module for any Tcl-enable software

  • KNIME Node Compiler -script your own networked nodes without Java programming

  • Database Cartridges-add chemistry query functions and in-database scripting to MySQL, PostgreSQL, SQLite, and others.

  • Webscripting-develop interactive chemistry Webb tools with (F) CGI backends and ExtJS JavaScript framework integration

  • Script Wrapper-transform your scripts into independent stand-alone ready-to run applications

  • Create Custom Libraries for cheminformatics core functions

  • Move, translate, filter, analyze, reformat chemistry data

  • Manipulation of chemical structures and comparisons between structures.



The base period of performance for this service is anticipated to be approximately twelve months with options to extend the term for two (2), twelve (12) month option periods. The Base Year period of performance is anticipated to be July 20, 2023 – July 19, 2024; option year 1 period of performance is anticipated to be



July 20, 2024 – July 19, 2025, and option year 2 period of performance is anticipated to be



July 20, 2025 – July 19, 2026.



Inclusion of options does not commit the Government to exercise the options.



This is not a solicitation for competitive quotations. An RFQ is not available nor are quotes being requested; however, if an interested party believes that it can meet the requirements, they may submit a price quote in writing along with a statement of capabilities.



Vendors submitting a quote shall comply with all applicable Federal, State and Locals laws, executive orders, rules and regulations applicable to its performance under this order. The following clauses and provisions cited herein are incorporate by reference into this announcement:

Vendors submitting a quote are advised to provide with their offer a complete copy of the following provisions:



FAR 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services (Dec 2022). The following FAR clauses apply to any order resulting from this notice FAR 52.212-4, Contract Terms and Conditions-Commercial Products and Commercial Services (Dec 2022)- with Addenda [Stop Work Order, FAR 52.242-15 (August 1989)]; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statues or Executive Orders-Commercial products and Commercial Services (March, 2023); FAR 52.217-8 Options to Extend Services and FAR 52.217-9 Option to Extend the Term of the Contract.





Quotes and related materials, or any questions must be submitted in writing by email to the Contracting Officer, Elena Chaparro Salgado at elena.leon2@nih.gov no later than 11:30 am Eastern Time on May 26, 2023. Not Collect calls will be accepted. No facsimile transmissions will be accepted. Any quotation, if timely received by an eligible offeror, shall be considered by the government. A determination by the Government not to complete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.
