Description

The Food and Drug Administration (FDA) intends to award a Sole Source firm-fixed price purchase order to the Federal Employment Law Training Group, located at 1583 CF Pours, Suite 100 Harrisonburg, VA 22802 accordance with the authority under FAR Part 13.501(a). This procurement is being conducted under simplified acquisition procedures in accordance with FAR Parts 12 and 13, including subpart 13.5. The NAICS code is 611710 - Educational Support Services.



The Office of Digital Transformation (ODT)’s managers and supervisors will benefit from coaching and training opportunities on how to deal with employee issues. When dealing with a misconduct action, complicated performance case, complaints, or legal actions, it can be beneficial to get coaching from experts in the field. Effectively managed teams will ultimately result in quality work products, emotionally intelligent leaders, and improved work-life balance for both supervisory and non-supervisory staff..



REQUIREMENT TO BE PERFORMED:



The objective of this requirement is to provide consultation services and training to FDA management officials on employee issues including misconduct, performance, PMAP writing, defending against EEO complaints, union issues, and other personnel scenarios. Below are the specific tasks:



• Provide training on holding employees accountable for performance and conduct for a group of approximately 25 participants, including instructional materials (e.g., textbook, class handouts, etc.)



• Provide training on eliminating microaggressions and bias in the federal workplace for a group of approximately 90 participants, including instructional materials (e.g., textbook, class handouts, etc.)



• Provide training on the supervisor’s role in Diversity, Equity, Inclusion, and Accessibility (DEIA) and EEO compliance for a group of approximately 90 participants, including instructional materials (e.g., textbook, class handouts, etc.)



• Drafting and reviewing documents and evidence for discipline and performance cases



• Preparing for litigation before the MSPB and EEOC



• Editing agency policy on performance and conduct expectations and procedures



• Drafting performance plans and writing standards to comply with OMB Directive M-17-22



• Preparing negotiators for bargaining with unions



• Developing administrative investigation plans



• Defending against non-meritorious harassment complaints



• Negotiating settlement agreements



This notice is not a request for competitive quotes. However, any party that believes it is capable of meeting the requirements as stated herein may submit a written response, i.e. capability statement, which clearly supports and demonstrates its ability to perform the requirements. Any response shall be received by the response date and time of this notice. Any response shall undergo review to determine if it can meet the requirements. A determination by the Government not to compete this proposed requirement based upon a response to this notice is solely within the discretion of the Government.
