REGULATORY AUTHORITY



This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13—Simplified Acquisition Procedures, and the procedures prescribed in FAR Subpart 13.106-1(b)(1), Soliciting from a single source.





The resultant contract will include all applicable provisions and clauses of the FAR in effect through the Federal Acquisition Circular (FAC) 2022-08, dated 10/28/2022.





DESCRIPTION



Pursuant to FAR Subpart 5.2—Synopses of Proposed Contract Actions,





THIS IS A PRE-SOLICITATION NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION.





The National Institute on Drug Abuse (NIDA), Office of Acquisition (OA), on behalf of the National Institute of Neurological Disorders and Stroke (NINDS) intends to negotiate and award a purchase order for a service and maintenance agreement for NINDS-owned MIF Fujifilm Visualsonics Vevo 3100/LAZR-X imager (Vevo 3100 S/N:04QX7B, LAZR-X S/N: 24194-3) and all its associated system parts (including the following transducers: MX400-0272, MX550D-0388, and MX250-0368) and software used by its researchers and scientists in the Mouse Imaging Facility (MIF).





The National Institutes of Health (NIH) is the nation’s leading medical research agency and the primary Federal agency whose mission is to seek fundamental knowledge about the nature and behavior of living systems and the application of that knowledge to enhance health, lengthen life, and reduce illness and disability, conducting, supporting and making medical discoveries that improve people’s health and save lives.





The National Institute of Neurological Disorders and Stroke (NINDS) is a part of the National Institutes of Health (NIH), which mission it is to seek fundamental knowledge about the brain and nervous system and to use that knowledge to reduce the burden of neurological disease for all people.





The NIH Mouse Imaging Facility (MIF) is dedicated to providing state-of-the-art anatomical, functional and molecular medical imaging capabilities for animal models of human disease. The Vevo 3100 is used to acquire high frequency ultrasound images of research animals for ongoing preclinical biomedical research studies. The LAZR component images the photoacoustic properties of living biological tissue (eg: tumors) or imaging probes. This project is to establish a new maintenance contract because the previous Vevo2100/LAZR was upgraded to the Vevo3100/LAZR-X in 2021 and was covered under warranty. This is a continuation of service for the new equipment that is just coming off warranty. A follow-on service and maintenance agreement is sought to ensure the highest quality up-keep of this equipment.

The anticipated period of performance shall include one 12-month base period and three 12-month option periods as follows.







Base Period: 5/08/2023-5/07/2024



Option Period One (1): 5/08/2024-5/07/2025



Option Period Two (2): 5/08/2025-5/07/2026



Option Period Three (3): 5/08/2026-5/07/2027

REASON FOR NON-COMPETITIVE ACTION





Only Fujifilm Visualsonics is capable of providing the necessary maintenance support service because the equipment requiring maintenance is proprietary to this company, the original equipment manufacturer. Fujifilm Visualsonics is the only contractor authorized and capable of providing service and parts to its proprietary systems including hardware and software. Use of any other contractor could jeopardize system integrity and functionality. The equipment requiring maintenance is used for research purposes and non-functional equipment, inappropriately calibrated equipment, or equipment with incorrect parts, software updates, or other service, would irreparably damage NIH research data. For these many reasons, Fujifilm Visualsonics is the only contractor capable of meeting the needs of this requirement.





CLOSING STATEMENT



This synopsis is not a request for competitive proposals. All responsible sources may submit a capability statement, however, which shall be considered by the agency. Responses to this notice must include clear and convincing evidence of the offeror’s capability of fulfilling the requirement.





In addition, the Unique Entity Identifier (UEI), the Taxpayer Identification Number (TIN), and the certification of business size must be included in the response. All offerors must have an active registration in the System for Award Management (SAM).





A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.





All responses must be received by 2:00 P.M., Eastern Standard Time on March 29, 2023.
